Terms and Conditions



Nothing contained in these Conditions will affect or restrict the statutory rights of a consumer.

These terms and conditions set out the extent of our responsibilities and liabilities in respect of any vehicle that is supplied by a supplying dealer. All vehicles are supplied by franchised dealers in the United Kingdom and our involvement is to act as an introducer between you and the selling dealer (“the Dealer”). As a result, any contract for the supply of your chosen vehicle will be between you, the customer and the Dealer.

1. Prices

a. Any prices that we quote include VAT, number plates, 12 months Road Fund Licence and the Vehicle Registration Charge; but exclude insurance and fuel and assume that you will collect your vehicle from the Dealer. If you wish to have the vehicle delivered, this will be subject to an additional charge by the Dealer.

b. Any price that is quoted is subject to confirmation and acceptance by the Dealer, having regard to any changes in the manufacturer’s list price or other duties. You will of course be under no obligation to continue with any purchase should the Dealer seek to increase the quoted price for this reason.

c. In addition to the quoted on the road price Nucar may at its discretion charge a document/admin fee of between £149 including vat and £249 including vat.

d. Prices are based on the customer collecting the vehicle from the supplying dealer.

2. Orders

a. In the event that you wish to place an order for a vehicle, you will be asked to sign an order request form which will clearly detail the make, model, specification, and supplying dealer contact details. The order request form may be generated by either Nucar or the supplying dealer subject to whether you deal with the dealer directly. Please be aware that contract formation is between you the customer and the supplying dealer.

b. If the vehicle that you wish to purchase is unavailable you will be advised of the fact by email or telephone, provided that you have given us the necessary details. You will be advised of either a revised lead time or the availability of alternative vehicles. Should you wish not to proceed with your order you may cancel without any financial penalty.

c. For ongoing progression of your vehicle order please contact the nominated franchised dealer, who’s details will be located on your individual order request. Whilst we shall endeavour to accurately reflect your wishes within the order request form, it is your responsibility to ensure that any contract documentation that you sign is accurate and that you have read any terms and conditions that may be applicable to your purchase.

3. Payment/Deposit

All payments will be made payable to the supplying dealer. Payment of all subsequent balances shall be made payable directly to the dealer or finance provider in such a manner as you agree with them.

4. Personal Finance - Personal Contract Purchase

To apply, you must be at least 18 years old and a UK resident (excluding the Channel Isles and Isle of Man). If you exceed the agreed contract mileage, there will be an excess mileage. In addition, you will be liable to pay for any accidental damage to the vehicle or excess wear and tear, with regard to its age and mileage.

PCP quotes obtained on this site are subject to confirmation.

Details you provide will be retained and may be used for credit assessment. A search will be made with Credit Reference Agencies (CRAs), who will record this for view by other Agency users. Your details may be checked with fraud prevention agencies and will be recorded if fraud is suspected. You must be entitled to disclose details of others referred to by you, and authorise us to search and record details at the CRAs about each of you. For individuals, sole traders and partnerships an "association" will be created at the CRA, which will link your financial records. Any sensitive information obtained will only be processed in order to provide the service requested. Your details will be treated in confidence. They may be shared within any company in the same Group as the finance provider (details available on request), together with the Introducer/ associated Companies/Insurers (if applicable) who will advise how they use your details. Your details may be disclosed where permitted by law or where you have consented. You may be contacted by mail, telephone, fax, email or other methods with details of products or services offered. If you do not want your details used for marketing write to the Data controller, Nucar, 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire LS27 9SE. You have a right to obtain a copy of details held about you upon payment of the statutory fee.

5. Business Finance.

Nucar utilises a panel of finance providers. All quotations are subject to availability. Please note any quotation supplied by us is subject to acceptance by the appropriate underwriters. All quotes are subject to movement in vehicle acquisition costs, interest rate changes.

6. Our Responsibilities

a) To deal with your enquiry in a professional manner.

b) To act as a broker to your purchase.

c) Accurately record your request for a quotation and any order request;

c) Liaise with franchised dealers within the United Kingdom in connection with a quotation, vehicle availability or vehicle purchase.

d) Pass on your order request to the Dealer where appropriate

7. Limitation of Liability

In view of our responsibilities as set out above, we do not accept liability for the following:

a) Any faults or defects in the vehicle supplied;

b) Any issues that you may have with the level of service provided by the Dealer;

c) Any loss or damage that you suffer arising out of the breach of contract by the Dealer;

d) Any defect in the title of the vehicle. Whilst we use every effort to find the most competitive price from franchised dealers within the United Kingdom, we cannot guarantee that the prices quoted by us are the lowest available.

8. Delivery

All delivery arrangements must be agreed between you and the Dealer. We do not accept any liability in the event that any vehicle is not delivered in accordance with any delivery arrangements that you have agreed.

Any costs for onward delivery will be met by the customer in full.

9. Data Protection

We will need to share your details with a Dealer and/or Finance provider for the purpose of obtaining a quotation, vehicle availability or placement of an order on your behalf. A nominated UK franchised dealer may contact you directly to assist you with enquiry. Where a dealer does contact you he/she will clearly introduce themselves stating whom they represent.

We do not sell or pass customer data on to any other third party agency. We may from time to time write to you with updates about the services that we offer. If you do not wish to receive these or you have any questions relating to data protection please write us at Nucar Limited, 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire LS27 9SE - for the attention of the Data Controller.

10. Distance Selling Regulations

The Distance Selling Regulations may apply to the contract that you enter into with the Dealer and you should speak to the Dealer directly about any rights of cancellation that you may have in respect of the vehicle that you are ordering. Please note that if you are a business customer, your contract will not be governed by these regulations and you may be liable to pay cancellation charges in the event that you decide to cancel your order. You should contact the Dealer if you have any queries or questions regarding this. Long Distance Regulations only applies to retail customers.

11. Governing Law

These terms and conditions are governed by English law and the parties agree to submit to the non-exclusive jurisdiction of the Courts of England and Wales.

12. Statutory Rights

Nothing within these Terms and Conditions affect your statutory rights to purchase goods that comply with their description, are of satisfactory quality and are fit for purpose. The vehicle purchase contract formation is between you, (the customer) and the nominated UK franchised dealer.

Your vehicle will be supplied with a manufacturer’s warranty and you may be able to purchase additional warranty cover from the Dealer depending on the make and model of your vehicle.

13. Complaints procedure:-

13.2 Manage your complaint quickly whenever possible

13.3 Learn from complaints and take action to improve our service. What to do if you have a complaint?

a. In the event of a complaint please contact Nucar on 0113 2525126 and request to speak to our Complaints Department, or write to Nucar, 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire LS27 9SE.

b. Please detail the nature of your complaint and provide contact details so we can respond to you promptly.

c. Your complaint will be logged and assigned a complaint reference number.

d. We will respond to you within 24 hours of receipt of your complaint.

e. We will endeavour to resolve your complaint immediately however if this is not possible we will keep you informed.

f. In a case where we are unable to resolve your complaint to your satisfaction and it is related to a finance issue please contact the Financial Ombudsman Service for independent adjudication.
